What’s my HHS compliance date?

 

This week’s question comes from Cliff:  

My property is not yet fully HHS compliant, how should I fill in the compliance date on the HHS Compliance Statement?


 

Actually, we expect this to be a common situation many landlords find themselves in. There are several deadlines for the Healthy Homes Standards (HHS) between now and July 2024. While the HHS Compliance Statement is now compulsory
for all new and renewed tenancy, the first deadline for actual compliance isn’t until July 2021 (i.e. HHS compliant within 90 days of
a new or renewed tenancy). It is not entirely inconceivable, between now and July 2021, that the landlord wouldn’t know when the property will become
compliant. Still, if there is a new or renewed tenancy, the HHS Compliance Statement will have to be filled out.

Our take is at least until July 2021, if your property is not already compliant to HHS that you could leave the field blank. Once July 2021 passes you
should have a better idea when your property will become compliant and be able to amend the statement accordingly.
