Now that key changes brought about by the Residential Tenancies Amendment Act 2019 (RTAA) have sunk in, landlords are starting to identify various operational issues that are ancillary but inevitably connected to compliance. Issues such as privacy concerns when disclosing insurance documentation as well as control over how tenants choose to live warrant further consideration. 

Experienced lawyer and speaker, Kristine King, returns to APIA to walk you through these issues that confront landlords day-to-day. She will be sharing her views on real and imagined risks, best practice, and a sensible way to deal with compliance going forward.

  • Overview of the key elements of the RTAA 
  • Insurance disclosure: How much is too much to disclose? What are the potential harms from a privacy point of view?
  • Tenant damage: Recommended ways to recover payments from tenants who have carelessly damaged the property. Should landlords be concerned over the carelessness vs accident debate? What is the insurance companies role in careless damage going forward? 
  • Unlawful premises: When Tenancy Services says "landlords must comply with all legal requirements relating to buildings and health and safety that apply to the premises" what does that mean? What level of control does the landlord have over how tenants occupy sleep-outs and garages? 
  • Meth: What are the testing requirements? What if the property tests meth-positive during the tenancy, what flow-on effect would that have on the tenant? What if the tenant withholds permission to test? 
Speaker

Kristine is a director of Duncan King Law and works primarily in the areas of property, commercial law and trusts and has a passion for working with property developers and property traders.

In addition to her legal work, Kristine is the Auckland area legal speaker for the ANZ Property Unlocked Seminar series and undertakes staff training on property issues for organisations such as ANZ and Bayleys. Kristine also provides specialist advice to the New Zealand Law Society on property matters during her work as a Standards Committee member.
